
SCIA launches the new Panel of Arbitrators

South China International Economic and Trade Arbitration Commission (also known as Shenzhen Court of International Arbitration, hereinafter the “SCIA”) has, after the deliberation of the NinthCouncil Meeting, decided to adopt the new Panelof Arbitrators of SCIA. This Panel of Arbitrators shall be applied to the cases accepted by SCIA (including cases to be submitted to “South China International Economic and Trade Arbitration Commission” or “Shenzhen Court of International Arbitration”, or “China International Economic and TradeArbitration Commission South China Sub-commission” or “China International Economic and Trade Arbitration Commission Shenzhen Sub-commission” pursuant tothe agreement of the parties) since December 1, 2015.
The Council of the SCIA hasalso decided to adopt the Panel of Arbitrators of SCIA High-Technology and Intellectual Property Arbitration Centre, the Panel of Arbitrators of SCIA Maritime and Logistics Arbitration Centre and the Panel of Arbitrators of the SCIA Financial Arbitration Centre since December 1, 2015, and these threeindustry-specific panels of arbitrators will be recommended to the parties as an integral part of the Panel of Arbitrators of SCIA. Since the SCIA High-Technology andIntellectual Property Arbitration Centre, the SCIA Maritime and Logistics Arbitration Centre and the SCIA Financial Arbitration Centre are established bythe SCIA, cases with arbitration agreement to submit disputes to these three centresshall be accepted and heard by the SCIA, and the parties may select arbitrators from the above industry-specific panels of arbitrators or other arbitratorsfrom the Panel of Arbitrators of SCIA, or otherwise excise their rights concerning the selection of arbitrators pursuant to the Arbitration Rules of the SCIA and the agreementbetween the parties.
There are totally 870 arbitrators in the new Panelof Arbitrators. Thestructure of arbitrators exhibits three major characteristics:
Further enhancement of internationalization. Amongthe 870 arbitrators, there are 353 from jurisdictions outside mainland China (accountingfor 40.6% of the total arbitrators), increased by nearly 3 percents comparedwith the previous panel of arbitrators and consistent with the requirement of “at least one third arbitrators from outside jurisdictions” prescribed by the Regulations on the Administration of Shenzhen Court of International Arbitration (for TrialImplementation), which isa unique legislation of Shenzhen Special Economic Zone specially authorized bythe Standing Committee of the National Congress.
Even greater regionaldiversification. First, the arbitrators come from 50countries and/or regions, with a more diversified distribution in Asia, Europe,
Close integration ofprofession and industry. The Panel of Arbitrators contains three industry-specific panels, for example, the Panel of Arbitrators of SCIA High-Technology and Intellectual Property Arbitration Centre, the Panel of Arbitrators of SCIA Maritime and Logistics Arbitration Centre and the Panel of Arbitrators of SCIA Financial Arbitration Centre. The Council selects panel arbitrators with rich experience,strong ability and good reputation in the above three industries from among domestic and international candidates, and thus produces the three in dustry-specific panels of arbitrators that complement the major panel of arbitrators. Specifically, the Panel of Arbitrators of SCIA Maritime and Logistics Arbitration Centrecontains 112 arbitrators, including 50 domestic arbitrators and 62international arbitrators accounting for 55.4%, and a significant number ofthem are world-famous experts in maritime and logistics.The Panel of Arbitrators of SCIA High-Technolog yand Intellectual Property Arbitration Centre contains 95 arbitrators,including 50 domestic arbitrators and 45 international arbitrators accountingfor 45.4%, so as to focus on services targeted at the Chinese and foreign high-tech enterprises.The Panel of Arbitrators of SCIA Financial Arbitration Centre contains 190 arbitrators, most of whom aresenior experts of banking, securities, insurance, trust, fund and capital investment from China or abroad.
Through this round of appointment of panel arbitrators, the SCIA further absorbs theexperts from key industries and newly emerging industries, improves the professional structure of arbitrators, and continually providesdomestic and international parties with high-quality service of commercialarbitration in accordance with the SCIA’s corevalues: independence, impartiality, and innovation.
