    Financial Leasing Experts Committee

    Financial leasing, which involves both capital raising and asset raising, is the second most important way of financing only to bank credit in the world. China's financial leasing industry has been experiencing arduous exploration for many years. Recently, China's financial leasing companies have shown a rapid growth in quantity and business volume due to the incorporation of new financial leasing companies into the financial leasing sector, the decentralization of approval authority for foreign financial leasing companies, and the acceleration of pilot projects related to domestic financial leasing companies. Financial leasing is becoming an important way for China to attract foreign investment, carry out technological transformations, and renew equipment for large and medium-sized state-owned enterprises. With the growth of financial leasing transactions taking place, more and more disputes involving financial leasing contracts have occurred. Because of this, it has become more important for actors to know how to regulate these transactions, prevent legal risks, and seek out the best solutions within the financial leasing industry.


    With the continuous innovation of the financial leasing industry, financial leasing disputes have been becoming increasingly complex. This has resulted in a demand for professionals who are familiar with not only the relevant laws but also the transaction rules and industry practices to act as arbitrators. In March 2017, the Shenzhen Court of International Arbitration (SCIA) established the Financial Leasing Experts Committee to resolve related legal cases by experts. In addition, SCIA has cooperated with the Justice Bureau of the Shenzhen Municipality, the Authority of Qianhai, and other organizations in order to compile the Industry Standards of the Qianhai Shenzhen-Hong Kong Modern Service Industry Cooperation Zone for Financial Leasing. The institution has been focused on defining the current industry realities, emphasizing a case analysis approach, learning from the international experience, and summarizing the relevant standardized operation procedures of the industry.
