    SCIA and HKIAC Strengthen Cooperation

    Since 2018,Shenzhen Court of International Arbitration (also known as “South China International Economic and Trade Arbitration Commission” and “Shenzhen Arbitration Commission”, the “SCIA”) and Hong Kong International Arbitration Centre(HKIAC)updated arbitration rules separately,which drew the attention of legal and business professionals at home and abroad. On July 2, 2019, SCIA and HKIAC jointly held a seminar on Arbitration Rules & Signing Ceremony of the Closer Cooperation Agreement in the conference hall of SCIA headquarters, with the aim to enhancing exchanges and to promote cooperation between Shenzhen and Hong Kong under the context of “One Country, Two Systems, Three Jurisdictions”, and to better serve the need of dispute resolution in Asia-Pacific region. As the first two international arbitration institutions established in the 1980s in the Guangdong-Hong Kong-Macao Greater Bay Area, the Seminar & the Signing of the Closer Cooperation Agreement is viewed as an important implementation of the Outline Development Plan for the Guangdong-Hong Kong-Macao Greater Bay Area (the “Outline”) which requires “improving international commercial dispute resolution mechanism, building an international arbitration center, supporting the exchanges and cooperation between Guangdong, Hong Kong and Macao arbitration and mediation institutions and offering arbitration and mediation services to facilitate the economic and trade development in the Greater Bay Area”, and also an important initiative to promote international arbitration cooperation in the Greater Bay Area.
     
     
    The event was hosted by Ms. Chi Wenhui, Legal Counsel of the SCIA. 
    In the opening ceremony, Liu Xiaochun, President of the SCIA and Sarah Grimmer, Secretary-General of the HKIAC delivered their opening remarks respectively.
    In his speech, President Liu Xiaochun reviewed the exchanges and cooperation between Hong Kong and Shenzhen since the reform and opening up of China. He pointed out that the arbitration institutions of Hong Kong and Shenzhen have played an important role in promoting the economic and trade development between the two regions in more than 30 years’ friendly cooperation. With the advancement of the national strategy of the Greater Bay Area, the arbitration institutions of the two regions will further deepen cooperation and promote mutual recognition, symbiosis, convergence and integration in arbitration rules and dispute resolution mechanisms. HKIAC Secretary-General Sarah Grimmer pointed out in her remarks that SCIA and HKIAC, as the two longest-established international arbitration institutions and the most important neighbors in Guangdong-Hong Kong-Macau Greater Bay Area, have stayed in an excellent partnership so far. In the context of the Greater Bay Area, the two representative arbitration institutions will strengthen cooperation to build a bridge for arbitration services in the Greater Bay Area.
     
     
    President Liu Xiaochun and Secretary-General Sarah Grimmer, as the representative of the SCIA and HKIAC, signed the Closer Cooperation Agreement. More than 100 legal and business professionals from home and abroad attended the seminar and witnessed the signing ceremony.
    During the Seminar, five speakers, Mr. Yang Tao, Assistant President of the SCIA & Director of International Cooperation and Development Department, Dr. Yang Ling, Deputy Secretary-General of HKIAC, Dr. Song Lianbin, Professor of Law & Doctor’s Tutor, Faculty of International Law of the China University of Political Science and Law, Mr. Gao Feng, Managing Partner of King & Wood Mallesons, and Dr. Yang Fan, Dispute Resolution Manager of King & Wood Mallesons (Hong Kong Office), delivered keynote speeches and shared their insights respectively on four different topics: “Interpretation on 2019 SCIA Arbitration Rules”, “Interpretation on 2018 HKIAC Administered Arbitration Rules”, “SCIA vs. HKIAC: Highlights of the Arbitration Rules”, and “A Comparison Between the Similarities and Differences of Arbitration Practice in Mainland China and Hong Kong SAR -From the Perspective of An Attorney”, introduced the innovations and highlights of the arbitration rules of the two institutions, as well as the application in practice.
    In the following panel discussion session, the keynote speakers conducted in-depth comparisons and conversations on issues such as how to ensure efficiency, bona fide cooperation, the innovation trend of international arbitration, and how to promote cross-border cooperation in legal services in Greater Bay Area.
    In the Q&A session, the participants actively asked questions to and interacted with the keynote speakers on topics such as party autonomy in arbitration, the rule of amiable compositeur, and the use of technology in arbitration, comparing and analyzing the interpretation and connotation of arbitration rules for better application in arbitration practice.
    According to the Closer Cooperation Agreement signed by SCIA and HKIAC, the two institutions will jointly promote arbitration and mediation in international commercial and investment dispute resolution and enhance exchanges between Hong Kong and Shenzhen. The two institutions will also conduct in-depth cooperation regarding the recommendation of panel of arbitrators and mutual assistance of facilities in order to promote mutual recognition, symbiosis, convergence and integration of the arbitration system, arbitration rules and dispute resolution mechanism in the Greater Bay Area, and jointly build a hub for international legal services and dispute resolution in the Asia-Pacific region.
